PERSONVERNERKLÆRING (Kunder og sluttbrukere)

Vær oppmerksom på at dersom vi har inngått en databehandleravtale (DPA) med din arbeidsgiver eller en annen bestiller, gjelder ikke denne personvernerklæringen for deg. I slike tilfeller følger vi databehandleravtalen og eventuelle tilleggskrav fra arbeidsgiveren din, for eksempel knyttet til lagring, sletting eller formål med behandlingen av personopplysningene dine.

Denne personvernerklæringen forklarer hvordan Eduhouse Oy og dets konsernselskaper samler inn, behandler og videreformidler personopplysninger når du besøker nettsiden vår eller når vi kontakter deg i forbindelse med markedsføring og salg.

Tjenesten kan være tilgjengelig på én eller flere plattformer eller domener. Eduhouse Oy og dets ansatte, datterselskaper og samarbeidspartnere forplikter seg til å beskytte ditt personvern og dine personopplysninger. 2. HVOR SAMLER VI INN DATA FRA?

Vi samler inn personopplysninger på flere måter. Hovedsakelig gjelder dette:

  • Når du registrerer deg for nyhetsbrev, tester tjenesten vår, deltar på arrangementer eller kontakter oss.
  • Fra interne eller felles registre i Eduhouse-konsernet.
  • Når du besøker nettstedet vårt eller bruker tjenestene våre – for eksempel ved innlogging eller kommunikasjon.
  • Fra andre kilder der lovverket tillater det, som sosiale medier, offentlige registre, samarbeidspartnere eller adresseregister.

 

3. HVILKE OPPLYSNINGER BEHANDLER VI?

Vi behandler blant annet:

  • Informasjon om potensielle kunder: navn, stilling, telefonnummer, e-post, adresse og interesser.
  • Bruksdata fra nettsted, tjeneste og sosiale medier: innloggingsinformasjon, IP-adresse, seerdata, deltakelse, resultater, chattehistorikk, notater og informasjonskapsler.
  • Ved livearrangementer som fjernundervisning og coaching: lyd/bilde dersom kamera/mikrofon er aktivert, mål og ønsker notert i våre systemer. Eventuelle opptak anonymiseres.
  • Annen informasjon du frivillig deler med oss, f.eks. ved påmelding til arrangementer, webinarer eller prøveperioder.
  • Klikk- og åpningsstatistikk for nyhetsbrev.
  • Øvrige opplysninger gitt etter ditt samtykke.

Eduhouse kan kombinere data fra ulike kilder for formål nevnt her. Du velger selv om du vil dele personopplysninger, men uten dem kan vi ikke tilby tjenesten.

 

4. HVA ER FORMÅLET MED BEHANDLINGEN, OG HVA ER DET RETTSLIGE GRUNNLAGET?

Vi behandler kun personopplysninger som er nødvendige for å levere tjenesten vår, følge opp kunder og utvikle forretningen.

4.1 Markedsføring

Hvis du abonnerer på nyhetsbrev, tester tjenesten eller deltar i markedsføringsaktiviteter, kan vi sende deg relevant informasjon med ditt samtykke. I noen tilfeller kan vi kontakte deg basert på vår berettigede interesse, dersom vi vurderer at tjenesten er relevant for din profesjonelle rolle. Du kan når som helst reservere deg mot slik behandling (se punkt 9).

4.2 Tjenesteutvikling, datasikkerhet og rapportering

Vi behandler også data for undersøkelser, rapportering og forbedring av våre tjenester og systemer, samt for å forebygge misbruk eller svare på rettslige krav. Dette skjer på grunnlag av vår berettigede interesse.

4.3 Behandling innen Eduhouse-konsernet

Selskap innen konsernet kan dele informasjon med hverandre, for eksempel for salg, kundeservice, administrasjon og rapportering. Også dette er basert på berettiget interesse.

4.4 Andre formål

Dersom du har samtykket til andre former for behandling, kan vi behandle data i henhold til det. Du kan når som helst trekke tilbake samtykket ditt.

 

5. DELING OG OVERFØRING AV PERSONOPPLYSNINGER

Vi kan dele dine opplysninger:

  • Når det kreves av lov, for eksempel ved forespørsler fra myndigheter.
  • Med samarbeidspartnere som behandler data på våre vegne, eksempelvis for markedsføring eller kursutvikling.
  • I forbindelse med fusjon, salg eller omorganisering.
  • For å ivareta våre rettigheter, forhindre misbruk eller sikre trygghet.
  • Med din arbeidsgiver, dersom lisensen din er kjøpt av dem.

5.1 Innen Eduhouse-konsernet

Data kan deles mellom selskaper i konsernet i tråd med gjeldende lov, basert på felles forretningsdrift og kundeoppfølging.

5.2 Overføring utenfor EU/EØS

Ved deltakelse i enkelte markedsføringswebinarer kan data overføres utenfor EU/EØS. Vi sørger da for nødvendige beskyttelsestiltak, som standardavtaler godkjent av EU-kommisjonen.

6. INFORMASJONSKAPSLER (COOKIES)

Vi bruker cookies og lignende teknologier på våre nettsider (www.eduhouse.no og app.eduhouse.no) for å forbedre funksjonalitet, brukervennlighet og analysere bruk. Cookies gjør det mulig for oss å tilby en bedre opplevelse og målrettet markedsføring. Du kan deaktivere eller begrense cookies i nettleseren, men dette kan påvirke funksjonaliteten.

7. LAGRING AV PERSONOPPLYSNINGER

Vi lagrer dine data så lenge det er nødvendig for formålene som er beskrevet her. Når det ikke lenger er behov eller lovpålagt, blir dataene dine slettet.

Vi beskytter dine opplysninger med tekniske, organisatoriske og fysiske tiltak mot uautorisert tilgang, tap eller misbruk. Tilgangen er begrenset til autoriserte personer. Selv om vi gjør vårt beste for å beskytte informasjonen din, kan vi ikke garantere full sikkerhet. Du vil bli varslet ved eventuelle sikkerhetsbrudd i henhold til gjeldende lovverk.

This Eduhouse Privacy Policy tells you how we collect, use, disclose and in other ways process your personal data. Here, we also explain your rights, how to contact us and how we safeguard your data.

 Please note that if we have signed with your employer  a data processing agreement (DPA), this data privacy policy does not apply to you. In these cases we are bound by the DPA and additional instructions that your employer may have given to us as regards personal data processing, for instance sustaining or deleting your data or the processing purposes.

This Privacy Policy (“Privacy Policy”) describes how Eduhouse Oy and its Group companies collect, process and disclose your personal data when providing you with educational services in the form of online training, distance learning, online coaching or similar services (“Service”) and when you visit our website.  The Service may be located on one or more systems. Eduhouse and its employees, partners, subsidiaries and affiliates are committed to protecting your privacy and personal data. Eduhouse processes your personal data in accordance with international and European data protection principles and current legislation on the processing of personal data.

We are constantly developing our services and therefore reserve the right to change this Privacy Policy by notifying you of any changes on this page. The changes will take effect when the updated Privacy Policy is published. The processing of personal data is necessary for conducting our business.


1 WHO IS CONTROLLER?

2 WHERE DO WE COLLECT THE DATA?


Your personal data can be collected in different ways. As a general rule, we collect and process personal data that

• you provide to us when you interact or do business with us, for example, when you register or log in to our Service or subscribe to our newsletter 
• your employer or other subscriber of the Service has provided to use when the decision to introduce the Service has been made and the end users of the Service have been identified
• we have obtained from the internal or shared registers of companies belonging to the Eduhouse Group
• we obtain in connection with your use of the Service
• is obtained from other sources to the extent permitted by applicable laws, such as Eduhouse’s social media channels, the Trade Register, the Population Information System, the Business Information System, the service providers that collect contact details of potential customers and representatives, or the Postal Service’s Address Information System.


3 WHAT INFORMATION DO WE COLLECT?


We collect and process categories of personal data including:

• Basic information about the users and administrators (customer contact persons) of the customer organisation, such as name, job title and relationship to the represented company, email address, telephone number, organisation’s visiting, invoicing and postal address, and language of communication
• Customer relationship data, such as service and subscription information, payment information, billing information, marketing consents and prohibitions, and customer satisfaction survey results
• Customer communications and related correspondence and records of data subjects’ rights;
• Personal data generated or collected in connection with the use of our website, social media channels and Service, such as user  log data concerning the use of the Service, course views, enrollments and completions, test results, chat conversations, use of the notes field in the online training service, IP address, and data collected through cookies or similar technologies
• Video and audio with camera and/or microphone on during distance training, online coaching or other live sessions. We might record the session to provide the recording for participants; we will let you know beforehand about the recording.
• Click-through and open rates for newsletters 
• Other data provided on a case-by-case basis subject to your consent.

Eduhouse may combine the personal data collected from various sources for the purposes set out in this Privacy Policy. You do not have to provide us with personal data, but a failure to do so may make it impossible for us to provide the Service.


4 FOR WHAT PURPOSES DO WE PROCESS DATA AND WHAT ARE THE LEGAL BASES FOR PROCESSING YOUR PERSONAL DATA?


We only process personal data that is necessary for pursuing our business, managing customer relationships and developing the Service, as well as for other appropriate commercial purposes.

We process your personal data for the following purposes:


4.1 Provision of the Service and customer relationship management


We process your personal data primarily to provide and deliver our Service to you or the company you represent and to manage and maintain the customer relationship between you or the company you represent and us. Such activities include customer communications, such as sending newsletters, bulletins and event invitations, customer service, as well as managing direct marketing bans and any other customer specific requests.

If you are a subscriber to the Service, we also process your personal data for billing purposes and customer relationship analysis. We also collect operational information related to reporting on the customer usage of the Service, including end user training, testing, and content reviews.

In such situations, the legal basis for processing the data is the fulfillment of the contract or a legitimate interest. We need to process your personal data in order to process and manage your purchases, orders, payments, requests for information or communications or to provide you with our Service.

4.2 Marketing and Sales

We may contact you to inform you about new features, content or additional services of the Service. Unless otherwise agreed, we may contact you regardless of whether you are a user or an administrator within the customer organisation. For these purposes, we process your data on the basis of legitimate interest.

We also collect statistical and analytical information about your website behavior and process your purchase and viewing history to provide you with targeted communications and marketing materials and to improve our services. We also use website statistics for customer segmentation for our sales processes. The use of cookies and other similar technologies is based on your consent.


4.3 Service development, data security and in-house reporting


We may also process your personal data for marketing research, customer surveys, opinion polls and internal reporting, as well as to develop our services. We may also use personal data to compile internal reports for the proper management of our business. 

We also process your personal data to ensure the security of the Service and website, to improve the quality of the Service, and to test and develop the Service and related services, systems, tools and processes. 

In addition, we may process your personal data if it is necessary to prevent fraud or other criminal activity or to respond to possible legal actions or claims.

In these cases, the processing of personal data is based on our legitimate interest.


4.4 Data processing within the Group


A company within the Eduhouse Group (data controller) may disclose personal data to other companies within the Eduhouse 's Group to the extent permitted by applicable law.  We might transfer the data for the sales, customer relationship management, business development or administrative (such as using centralized information and communication systems) purposes.

In these cases, the processing of personal data is based on our legitimate interest.


4.5 Other purposes

We may also process your personal data for other purposes that you have given your consent to.

You always have the right to object to the processing of your personal data on the basis of your legitimate interests.


5 TRANSFER AND DISCLOSURE OF PERSONAL DATA


We may disclose your personal data to third parties:

• to the extent permitted or required by law, for example, to comply with a request for information by a competent authority or in connection with legal proceedings.
• when our partners process personal data on our behalf in accordance with our instructions. Such processing may relate, for example, outsourcing training services.
• if we are involved in a merger, reorganization or sale of business or part there of
• when we believe that disclosure is necessary to exercise our rights, protect your safety or the safety of others, investigate abuses, or respond to a request from a public authority
• if your user lisence has been purchased by your employer or other service subscriber, we will share your performance and usage data with designated contacts and
• with your consent, to the parties to whom the consent relates.


5.1 Disclosure of personal data within the Eduhouse Group

A company within the Eduhouse Group (data controller) may disclose personal data to other companies within the Eduhouse 's Group to the extent permitted by applicable law.  We might transfer the data for the sales, customer relationship management, business development or administrative (such as using centralized information and communication systems) purposes.


5.2 Transfer of personal data outside the European Union (EU) or the European Economic Area (EEA)

Your personal data is not currently transferred outside the EU or EEA. All personal data is located in Finland or within EU / EEA area.

Cookies are small text files placed on your device to collect and remember useful information and to improve the functionality and usability of our website. We may also use cookies and other similar technologies for statistical purposes, such as compiling statistics on the use of the website to understand how users use the website and thereby improve the user experience. We also use cookies to target marketing. You can disable cookies, restrict their use or delete them from your browser. As cookies enable our website to function, restricting their use affects the usability of the website.

7 RETENTION OF PERSONAL DATA


We will only retain your personal data for as long as necessary to fulfill the purposes of use specified in this Privacy Policy. As a rule, your personal data will be stored for the duration of your relationship with us. Parts of your personal data may be retained, to the extent permitted or required by applicable laws, even after the expiry of the customer relationship or for as long as required for the purposes of this data file and the rights and obligations of the parties involved. In addition, we may process your personal data for sales and marketing purposes before the start, or after the expiry, of the customer relationship, where there is a legitimate legal basis for doing so. Your personal data will be deleted when its retention is no longer necessary to comply with the law or the rights and obligations of either party.


8 DATA SUBJECT RIGHTS


You have the right to verify your personal data. You can also request at any time that your personal data be corrected, updated or deleted. Please note, however, that personal data that is necessary for the purposes defined in this Privacy Policy or that is required to be retained by law cannot be deleted. You have the right to object to or restrict the processing of your personal data, such as profiling, to the extent required by applicable laws. If you object to direct marketing, the processing of your personal data will be prevented with regard to active use in direct marketing. However, your data may be retained to the extent necessary to comply with the opt-out.

In certain cases, you have the right to transfer the personal data you provide to us from one system to another, i.e. you have the right to receive your personal data in a structured, commonly used, machine- readable format, and to transfer your personal data to another controller in accordance with applicable laws.

If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. After that, we will not process your personal data unless there is another legal basis for doing so.


You can exercise your rights by sending a request for inspection or other request concerning your personal data to dpo@eduhouse.fi. We will respond to your request within one month of your request, unless there is a specific reason to extend the response time.

9 DATA SECURITY


Your personal data is protected by physical, organisational and technical means against loss, destruction, misuse and unauthorized access or disclosure. The register is stored in a database protected by firewalls, passwords and other technical means, which is only accessible to authorized persons for the performance of their duties.
Please note that all data security violations cannot be prevented even by appropriate safeguards. Any data security breaches are reported to you in accordance with applicable laws and recommendations.


10 CHANGES TO THE PRIVACY POLICY


We are constantly developing our services and therefore reserve the right to change this Privacy Policy at any time. The changes will take effect once they are published on this page. We may e.g. make changes to this Privacy Policy, when privacy laws or regulations are updated.

3. HVILKEN INFORMASJON SAMLER VI INN?

Vi samler inn og behandler følgende kategorier av personopplysninger:

  • Informasjon om potensielle kunder (prospects): navn, stilling, telefonnummer, e-post, bedriftsadresse og interesser.
  • Personopplysninger generert eller samlet inn gjennom bruk av nettstedet, sosiale medier og tjenester: brukernavn, passord, identifikasjonsinformasjon, IP-adresse, visninger av opplæring, deltakelse og prestasjoner, loggdata, testresultater, chat, notater, informasjon via informasjonskapsler eller tilsvarende teknologi.
  • Ved deltakelse i fjernundervisning, nettkurs eller livearrangementer behandler vi video og lyd dersom kamera og/eller mikrofon er på. I nettkurs kan vi registrere deltakerens mål og ønsker. Hvis arrangementet tas opp, slettes all personlig informasjon om deltakere fra opptaket.
  • Annen informasjon du deler i forbindelse med webinarer, nyhetsbrev, prøvetilgang eller markedsaktiviteter.
  • Klikk og åpningsrate på nyhetsbrev og reklameutsendelser.
  • Øvrige opplysninger definert fra sak til sak med ditt samtykke.

Eduhouse kan kombinere personopplysninger fra ulike kilder for formålene beskrevet i denne erklæringen. Du er ikke forpliktet til å gi oss dine personopplysninger, men uten dem kan det være umulig å tilby tjenesten til deg.

 

4. TIL HVILKE FORMÅL BEHANDLER VI PERSONOPPLYSNINGER OG HVA ER DET RETTSLIGE GRUNNLAGET?

Vi behandler bare personopplysninger som er nødvendige for å drive virksomheten, ivareta kundeforhold, utvikle tjenesten og andre legitime forretningsformål.

4.1 Markedsføring
Hvis du ikke er kunde, men har abonnert på nyhetsbrev, registrert deg for prøvetilgang eller deltatt i markedsføring, kan vi sende markedsføringskommunikasjon basert på samtykke. I enkelte tilfeller kan vi også kontakte deg basert på berettiget interesse, for eksempel hvis din yrkesrolle indikerer at tjenesten er relevant for deg. Du kan når som helst motsette deg behandling for direkte markedsføring, telefonsalg og profilering (se punkt 9).

4.2 Tjenesteutvikling, datasikkerhet og intern rapportering
Vi behandler opplysninger for kundeundersøkelser, intern rapportering og tjenesteutvikling. Vi sikrer også datasikkerhet, kvalitet og forebygger misbruk. Behandlingen baseres på vår berettigede interesse.

Ved deltakelse i markedsføringswebinarer kan data overføres utenfor EU/EØS. Vi bruker da egnede sikkerhetsmekanismer, som EUs standard kontraktsklausuler.

9. DATASIKKERHET

Dine opplysninger beskyttes med fysiske, organisatoriske og tekniske tiltak mot tap, misbruk og uautorisert tilgang. Databasen er brannmur- og passordbeskyttet, kun tilgjengelig for autoriserte personer.

This Privacy Policy (“Privacy Policy”) describes how Eduhouse Oy and its Group companies collect, process and disclose your personal data when we contact you for marketing or sales purposes or you take part in our marketing webinars or other similar events. The Service
may be located on one or more systems. Eduhouse and its employees, partners, subsidiaries and affiliates are committed to protecting your privacy and personal data. Eduhouse processes your personal data in accordance with international and European data protection principles and current legislation on the processing of personal data.

We are constantly developing our services and therefore reserve the right to change this Privacy Policy by notifying you of any changes on this page. The changes will take effect when the updated Privacy Policy is published. The processing of personal data is necessary for conducting our business.

2 WHERE DO WE COLLECT THE DATA?


Your personal data can be collected in different ways. As a general rule, we collect and process personal data that

• you provide to us when you interact or do business with us, for example, when you  subscribe to our newsletter or a trial of our Service, participate in our marketing events or campaigns or contact us
• we have obtained from the internal or shared registers of companies belonging to the Eduhouse Group
• we obtain in connection with your visit to the website or our marketing activities.
• is obtained from other sources to the extent permitted by applicable laws, such as Eduhouse’s social media channels, the Trade Register, the Population Information System, the Business Information System, the service providers that collect contact details of potential customers and representatives, or the Postal Service’s Address Information System.


3 WHAT INFORMATION DO WE COLLECT?


We collect and process categories of personal data including:

• Potential customers (prospects) and trial subscribers: first name, last name, organisation, title, telephone, email, organisation address and interests
• Personal data generated or collected in connection with the use of our website, social media channels and Service, such as user  log data concerning the use of the Service, course views, enrollments and completions, test results, chat conversations, use of the notes field in the online training service, IP address, and data collected through cookies or similar technologies
• Video and audio with camera and/or microphone on during distance training, online coaching or other live sessions. We might record the session to provide the recording for participants, we will let you know about the recording beforehand. 
• Other information you provide in connection with free webinars or events, newsletter subscriptions, trial subscriptions or other sales and marketing activities, such as your interests related to the Service
• Click-through and open rates for newsletters and advertisements
• Other data provided on a case-by-case basis subject to your consent.

Eduhouse may combine the personal data collected from various sources for the purposes set out in this Privacy Policy. You do not have to provide us with personal data, but a failure to do so may make it impossible for us to provide the Service.


4 FOR WHAT PURPOSES DO WE PROCESS DATA AND WHAT ARE THE LEGAL BASES FOR PROCESSING YOUR PERSONAL DATA?


We only process personal data that is necessary for pursuing our business, managing customer relationships and developing the Service, as well as for other appropriate commercial purposes.

We process your personal data for the following purposes:


4.1 Marketing

If you are not yet our customer and have subscribed to our newsletter or a trial of our Service, or have participated in our other marketing campaigns or events, we may send you marketing communications related to our Service based on your consent. We may also market or sell our services to you on the basis of legitimate interest if we feel that our Service is relevant to you based on your work role and position. In such cases, we contact you by telephone or email. You have the right, at any time, to object to the processing of your personal data for direct marketing, telemarketing and profiling purposes. 


4.2 Service development, data security and in-house reporting


We may also process your personal data for marketing research, customer surveys, opinion polls and internal reporting, as well as to develop our services. We may also use personal data to compile internal reports for the proper management of our business. 

We also process your personal data to ensure the security of the Service and website, to improve the quality of the Service, and to test and develop the Service and related services, systems, tools and processes.

A company within the Eduhouse Group (data controller) may disclose personal data to other companies within the Eduhouse 's Group to the extent permitted by applicable law.  We might transfer the data for the sales, customer relationship management, business development or administrative (such as using centralized information and communication systems) purposes.

In these cases, the processing of personal data is based on our legitimate interest.


4.4 Other purposes

We may also process your personal data for other purposes that you have given your consent to.

You always have the right to object to the processing of your personal data on the basis of your legitimate interests.


5 TRANSFER AND DISCLOSURE OF PERSONAL DATA


We may disclose your personal data to third parties:

5.1 Disclosure of personal data within the Eduhouse Group

A company within the Eduhouse Group (data controller) may disclose personal data to other companies within the Eduhouse 's Group to the extent permitted by applicable law.  We might transfer the data for the sales, customer relationship management, business development or administrative (such as using centralized information and communication systems) purposes.


5.2 Transfer of personal data outside the European Union (EU) or the European Economic Area (EEA)

Your personal data might be transferred outside of EU/EEA when you participate in our free marketing webinars. In such cases, we ensure that we have appropriate transfer methods in place (e.g. SCC, Standard Contractual Clauses issued by European Commission).

7 RETENTION OF PERSONAL DATA


We will only retain your personal data for as long as necessary to fulfill the purposes of use specified in this Privacy Policy. As a rule, your personal data will be stored for the duration of your relationship with us. Parts of your personal data may be retained, to the extent permitted or required by applicable laws.

Your personal data will be deleted when its retention is no longer necessary to comply with the law or the rights and obligations of either party.


8 DATA SUBJECT RIGHTS


You have the right to verify your personal data. You can also request at any time that your personal data be corrected, updated or deleted. Please note, however, that personal data that is necessary for the purposes defined in this Privacy Policy or that is required to be retained by law cannot be deleted. You have the right to object to or restrict the processing of your personal data, such as profiling, to the extent required by applicable laws. If you object to direct marketing, the processing of your personal data will be prevented with regard to active use in direct marketing. The register is stored in a database protected by firewalls, passwords and other technical means, which is only accessible to authorized persons for the performance of their duties.
Please note that all data security violations cannot be prevented even by appropriate safeguards. Any data security breaches are reported to you in accordance with applicable laws and recommendations.
